Having been involved in medical cannabis advocacy across North Carolina and Colorado since 2013, and having worked closely with the industry, I genuinely believed we were moving toward federal descheduling. Instead, the federal government is about to legislate us straight back to 1995.

In 2018, the Farm Bill accidentally legalized a multi-billion dollar hemp and THCA market. Instead of building a functional regulatory framework, Congress is hitting the panic button. Section 781 of Public Law 119-37 officially takes effect on December 11, 2026. It establishes a strict "total THC" standard that folds THCA into the calculation and caps finished products at a microscopic 0.4 milligrams per container.

Not per serving. Per container.

This automatically pushes almost all current THCA flower, vapes, and edibles back under Schedule I classification. You can legally buy a product today, but possessing that exact same product this December could trigger federal felony charges. 35 state attorneys general are aggressively demanding this ban take effect without delay to completely crush the market.

There is a brief window to stop this. Lawmakers have introduced H.R. 6209 (The American Hemp Protection Act) to repeal these restrictions before the deadline. Call the Capitol Switchboard at (202) 224-3121, ask for your representative, and tell them to support H.R. 6209.
