What the SAVE America Act Does
The bill would transform voter registration and voting across the country. It passed the House on February 11, 2026, with all Republicans and one Democrat backing it. President Trump has said he will not sign any other bills into law until the Senate passes it.
Main Criticisms
1. Documents many Americans don't have The bill requires Americans to show documents like a passport or birth certificate to register to vote. Research shows that more than 21 million Americans lack ready access to those documents — roughly half of Americans don't even have a passport.
2. REAL ID doesn't qualify The REAL ID driver's licenses of nearly all Americans would not work, as REAL IDs are proof of legal residence, not citizenship. Even the bill's own sponsor admitted during a 2025 hearing that the REAL IDs of the vast majority of citizens would not work.
3. Women with married names disproportionately affected Tens of millions of women changed their name after getting married, so their current names don't match their birth certificate.
4. Voter roll purges via a flawed database Every state would be required to submit its voter registration list to DHS for comparison against an error-ridden database, with no restrictions on what the federal government can do with that sensitive data once received.
5. Burdens on election officials The bill would place a massive unfunded burden on state and local election officials and expose them to significant legal risk. Election workers could go to prison for up to five years if they help register someone without the correct documents, even if that person is a citizen.
6. Disrupts online and mail registration Many rural voters heavily rely on remote voter registration methods that would be effectively blocked, such as registering online or mailing in an application, as well as mail-in voting.
7. Solves a problem that barely exists Existing law already requires all federal voter registration forms to require registrants to affirm their citizenship under penalty of perjury, and credible studies consistently show that instances of non-citizens voting in federal elections are exceedingly rare.
